About This Book
In Japan, 'litigation' has long been the assumed method for resolving disputes and troubles.
But is it truly the only option?
This book sheds light on 'Alternative Dispute Resolution (ADR)', a system not widely known in Japan, and explains its meaning and potential.
ADR (Alternative Dispute Resolution) is a method positioned as an alternative to, or alongside, litigation for dispute resolution. It emphasizes achieving mutually satisfactory solutions through discussion, aiming for a 'win-win resolution' where both parties are satisfied, rather than a 'win-lose' outcome.
A particularly noteworthy point is that ADR is a resolution method that prioritizes 'emotional satisfaction'. While legal solutions tend to focus on material and formal aspects, ADR considers the emotions and backgrounds of the parties involved. This proves particularly effective for issues closer to daily life, such as family disputes, workplace conflicts, and contractual disagreements.
What is justice?
What constitutes a 'resolution'?
This book not only introduces ADR as a system but also strongly poses the question, urging each individual to know that 'there are options other than litigation'.
