This was done in anticipation of the 'Child Sexual Violence Prevention Act' (Act on Measures to Prevent Child Sexual Violence, etc., by School Establishers and Private Education and Childcare Business Operators, commonly known as Japan DBS) coming into effect on December 25, 2026. A 'Survey Results Report Meeting' will be held (April 13, 2026 (Mon) 15:00-17:00, via Zoom).

To oblige business operators providing education and childcare services to children to take measures to prevent child sexual violence, etc., by their employees.
●Scope of the System
Businesses and operations are defined based on whether they have ① dominance, ② continuity, and ③ closedness in relation to children.

The Child Sexual Violence Prevention Act will begin amidst a situation where the recognized number of child sexual harm cases exceeds 5,000 annually *2. While schools and authorized childcare facilities are 'obligatory targets,' private educational institutions such as cram schools, sports clubs, and cultural classes remain 'certified targets' on a voluntary basis. Furthermore, for private institutions to be certified, there is a requirement for 'three or more instructors,' posing a challenge where 'small-scale businesses with two or fewer instructors (estimated at approximately 50,000 classrooms, excluding cram schools *3),' which constitute a large portion of the習い事 industry, are not even covered by the system.

This survey (155 valid responses) revealed the actual situation of harm and the vulnerability of governance in these private and small-scale習い事 settings. We will announce the aggregated and analyzed results of this survey and hold a 'Survey Results Report Meeting' where experts will make concrete proposals on how small-scale businesses not covered by the law should proceed with child safety measures.

■ Survey Results Summary
1. Serious Harm Situation: Over 1 in 3 Experienced/Witnessed Sexual Harm/Inappropriate Acts. High Barrier to Consultation Leads to Isolation.
49 respondents (31.6%, over 1 in 3) reported experiencing or witnessing some form of sexual harm or inappropriate act. Among them, 29 individuals (18.7% of the total, about 1 in 5) directly experienced harm themselves. Furthermore, only 30.6% of those who experienced harm were able to consult someone, with 22.4% responding that they 'wanted to but couldn't.' This suggests the potential for hidden harm in習い事 settings, where conditions of 'dominance, continuity, and closedness,' which are considered high-risk for sexual harm, are often present.

2. Support for DBS Obligation and Gap in Vulnerable Safety Systems
83.2% responded 'strongly agree' or 'agree' (average score 1.52 on a 5-point scale) to making Japan DBS (criminal record check) obligatory for習い事 instructors, confirming overwhelming support from the field. On the other hand, the 'documentation rate of safety regulations' in classrooms was only 13.5%, indicating that the governance foundation of individual classrooms, which would serve as recipients of the system, is extremely vulnerable.

3. Necessity of Multi-faceted Measures: Criminal Record Checks Alone Are Insufficient
While there is strong demand for making DBS criminal record checks obligatory, there is also a recognition that this alone is insufficient. There is a strong demand for promoting multi-faceted safety assurance measures, such as establishing specialized anonymous consultation services (54.2% desired) and building reporting systems for perpetrators (49.0%).

■ 'Voices from the Field' from Free Descriptions and Hearings
In this survey's free descriptions and hearings, 25 specific testimonies of harm were received.

・Actual Harm: 'In a workshop for elementary school students, they touched my whole body and hugged me tightly during changing,' 'An instructor touched my body during guidance,' 'After giving my LINE ID, they persistently invited me to meet alone,' etc. Many cases of harm and inappropriate acts using the superior position of an instructor were reported.
・Concealment and Secondary Harm: 'When I reported it to the head of the organization, I was blamed, saying it was my fault for being sexually harassed, and that I shouldn't speak ill of the master, and was threatened that if I told anyone, something worse would happen.' This shows the reality of concealment by closed organizations.

These testimonies are classified into 6 categories by type of act and published as a report. General opinions and requests regarding the Japan DBS system and child sexual violence prevention (such as concerns and mechanisms for preventing false accusations) are also summarized.

Representative of Hanasaka Administrative Scrivener Office. Develops community-based services such as inheritance, guardianship, and wills, mainly in northern Osaka. Quickly focused on 'Japan DBS,' which will be implemented in 2026, and receives numerous consultations from businesses such as after-school day services and social welfare councils.
