Approximately 8 years have passed since the application of EU GDPR began, and while it has become the global standard for personal information protection laws worldwide, enforcement tends to go beyond formal aspects (such as the establishment of privacy policies) and delve into practical operational aspects. Furthermore, significant legal revisions directly impacting business practices are successively occurring in major jurisdictions, such as the amendment of UK GDPR by DUAA (Data (Utilization and Access) Act 2025) in the UK, the amendment of the Children's Online Privacy Protection Act (COPPA Rule) to be enforced in June 2025 in the US, and the amendment of the California Consumer Privacy Act (CCPA Rule) to be enforced in stages from January 2026. This lecture will explain the practical points that Japanese companies should review, based on these latest trends and recent high-value enforcement cases.

Revisions and Enforcement Cases of Personal Information Protection Regulations in Major Asian Countries and Practical Considerations

Four and a half years have passed since the enforcement of China's PIPL on November 1, 2021, and practical know-how has accumulated. At the same time, enforcement risks are increasing, as evidenced by the first major penalty case announced in September 2025 against a Chinese local subsidiary of a foreign company for violating procedures related to cross-border transfer of personal information to its head office. In other Asian countries, India has enacted the DPDPA (Digital Personal Data Protection Act), requiring compliance by May 2027, and Vietnam will apply a new personal data protection law from 2026, replacing the conventional personal data protection decree. These are significant revisions in jurisdictions of high business importance to Japanese companies. Furthermore, in countries where personal information protection laws were previously enacted, such as Thailand, enforcement is being strengthened, with the Thai personal information protection authority announcing multiple enforcement cases. This lecture will explain the overview of China's PIPL and recent practical trends, and analyze enforcement practices from recent enforcement cases. It will also explain the overview of new laws in India and Vietnam, introduce enforcement cases along with an overview of Thailand's legal system, and explain practical considerations for compliance.
