The FSC today stated that it has completed the draft amendment to Article 8-1 of the "Regulations Governing the Qualifications and Concurrent Engagements of Responsible Persons of Insurance Enterprises and the Matters to be Complied With" (referred to as "these Regulations"). The draft began its 60-day public comment period on May 8 and is expected to be implemented as early as the end of July.

Cai Huoyan, Deputy Director of the FSC's Insurance Bureau, pointed out two major amendment focuses. First, the amendment to Article 8-1, Paragraph 1, Subparagraph 4, targets the existing requirement that those intending to serve as vice presidents, assistant vice presidents, and managers of insurance enterprises, or equivalent positions, must meet the active qualification condition of "having more than 10 years of work experience in professional fields such as information, technology, law, e-commerce, digital economy, financial accounting, or human resources." This will be amended to "having more than 10 years of work experience in specific professional fields."

Second, new authorization provisions will be added: "The specific professional fields referred to in Paragraph 1, Subparagraph 4 shall be separately prescribed by the competent authority." This shifts from the current method of explicitly listing the specific professional fields for managers to a general authorization for the competent authority to prescribe them.

Cai Huoyan pointed out that on the effective date of the subsequent draft, an order will be simultaneously issued in accordance with the authorization provisions, specifying the concrete scope of "specific professional fields" referred to in Paragraph 1, Subparagraph 4. In addition to the currently specified seven professional fields of information, technology, law, e-commerce, digital economy, financial accounting, and human resources, the future order plans to add five new fields: medical, investment, marketing, real estate, and sustainable economy.

Cai Huoyan stated that the FSC is promoting the financial action innovation regulatory adjustment platform. This case originated from a proposal by a member of the insurance regulatory review working group and integrated opinions from life insurance and property insurance associations. The main consideration was that if operators want to establish positions such as Chief Sustainability Officer, but the professional field of a Chief Sustainability Officer may not be within the original scope, thus adding fields such as sustainable economy. Furthermore, with the adoption of general authorization this time, if additional professional fields need to be added in the future, they can take effect immediately through the issuance of an order, making it more timely.
