(Central News Agency reporter Su Mu-chun, Taichung, 9th) Kuomintang (KMT) Legislator Yen Kuan-heng is accused of defrauding assistant fees, among other charges, through construction company owner Lin Chin-fu. The entire case is currently undergoing trial in its third appeal. The Taichung High Court, considering the risk of Yen Kuan-heng absconding, recently ruled to extend the restriction on his exit from the country and going to sea by 8 months. This ruling can be appealed.

The criminal ruling from the Taiwan High Court Taichung Branch states that Yen Kuan-heng, Lin Chin-fu, and others are accused of corruption and other crimes. On the 5th, a court session was held to give the prosecutor, defendants, and their lawyers an opportunity to state their opinions in court. The prosecutor stated that the two defendants were sentenced to 7 years and 10 months and 7 years and 8 months, respectively, by the original court, which is sufficient to establish the possibility of flight. There are reasons for restricting their exit from the country and going to sea, and these restrictions should be extended.

Yen Kuan-heng's lawyer stated in court that Yen Kuan-heng has appeared in court on time for all investigative and trial dates and has always believed that justice will clear his name, thus he has no intention of evading judicial judgment. Lin Chin-fu believes that his actions did not constitute corruption or other offenses, and although he was sentenced to heavy penalties, he believes justice will clear his name, so there is no need to abscond.

The collegiate bench deliberated that Yen Kuan-heng and Lin Chin-fu, dissatisfied with the second-instance judgment, have filed a third-instance appeal, which is currently being heard by the Supreme Court and has not yet been finalized. There are substantial reasons to believe that Yen Kuan-heng and Lin Chin-fu pose a risk of absconding to avoid the trial process and the execution of penalties. If the two leave the country or go to sea and do not return to Taiwan to accept trial or execution, it would also severely damage the national interest in prosecuting crimes.

The Taichung High Court ruled on the 6th that Yen Kuan-heng and Lin Chin-fu are both restricted from exiting the country and going to sea for 8 months, starting from the 11th. This ruling can be appealed.

According to the prosecutor's indictment, Yen Kuan-heng's luxury residence in Shalu District, Taichung, allegedly encroached upon 1097.14 square meters of state-owned land. After being reported in 2021, Yen Kuan-heng and construction company owner Lin Chin-fu, in the form of a "loan," lent NT$45.41 million to design company owner Chang Yu-ting. Chang Yu-ting then used the same amount to purchase the involved land and buildings from Yen Kuan-heng and others. This part involves offenses of encroachment and forgery.

Additionally, Yen Kuan-heng allegedly used Lin Chin-fu as a front to defraud NT$1.08 million in assistant fees. Among the key pieces of evidence are accounting ledgers such as the "Yen Dong Collection and Payment Summary Table" produced by Lin Chin-fu's wife, which also lists "Legislative Yuan salaries." This part involves offenses under the Anti-Corruption Act and other laws.

The Taichung District Court, in July 2024, sentenced Yen Kuan-heng to 7 years and 10 months imprisonment and deprived him of his civil rights for 3 years for corruption; for forgery, he was sentenced to 6 months imprisonment, which can be commuted to a fine; he was found not guilty of occupying state land. Lin Chin-fu was sentenced to 7 years and 8 months imprisonment and deprived of his civil rights for 2 years for corruption; for forgery, he was sentenced to 6 months imprisonment, which can be commuted to a fine; he was found not guilty of occupying state land. The Taichung High Court rejected the appeal in September last year, but the corruption part can still be appealed. (Edited by Chang Ming-kun) 1150509
