The Ministry of Justice has received an official letter from the Presidential Office, appointing Hsu Hsi-hsiang, Chief Prosecutor of the Supreme Prosecutors Office, as acting Prosecutor General starting tomorrow, to exercise relevant powers.

Hsu Hsi-hsiang, 63, holds a master's degree from National Chung Hsing University's Graduate Institute of Law. He has served as Prosecutor General of the Kinmen, Hsinchu, Changhua, and New Taipei District Prosecutors Offices, Chief Prosecutor of the High Prosecutors Office Taichung Branch, and Political Deputy Minister of Justice. He also served on secondment as Director of the Anti-Corruption Department of the Coast Guard Administration and Deputy Director-General of the National Security Bureau.

The Presidential Office issued a press release on March 13, stating that incumbent Prosecutor General Hsing Tai-chao's term would expire on May 7. President Lai Ching-te, in accordance with the Court Organization Act, nominated Hsu Hsi-hsiang as Prosecutor General and requested the Legislative Yuan to exercise its power of consent. However, the Legislative Yuan voted on this personnel consent case on the 5th, and with the 'disagree' votes from Kuomintang and Taiwan People's Party legislators, Hsu Hsi-hsiang did not meet the consent threshold and was therefore rejected. Hsu Hsi-hsiang stated that it was due to his own insufficient efforts.

Ministry of Justice officials stated on the 5th that they respect the Legislative Yuan's voting results. As the nomination of the Prosecutor General is within the President's authority, to maintain the normal operation of the Supreme Prosecutors Office and protect the rights of the people, they will, as per precedent, report to the Executive Yuan to forward to the President for the appointment of an acting Prosecutor General.

Since Hsing Tai-chao's term expires today, to avoid a vacuum in the Supreme Prosecutors Office's operations, the Ministry of Justice today received an official document from the Presidential Office, appointing Hsu Hsi-hsiang as acting Prosecutor General starting tomorrow, to exercise relevant powers.

According to the Court Organization Act, if the Prosecutor General's position becomes vacant or they are unable to perform their duties, the President shall resubmit a new candidate within three months, and appoint them with the consent of the Legislative Yuan.
