The Kaohsiung Branch of the High Court found the sentences too lenient and today changed them to 5 months for Mr. Pan and 6 months for Mr. Lin, both convertible to a fine. The case can still be appealed.

Taiwan High Court Kaohsiung Branch today issued a press release stating that Mr. Pan and Mr. Lin, for a mere reward of NT$5,000, lent their ID cards to purchase boat tickets, allowing Xu Shaodong and others to illegally depart under concealed identities, thus escaping heavy sentences and continuing to enjoy their criminal proceeds. The severity of the crime is immense and incomparable to ordinary cases of aiding illegal entry/exit.

The collegiate bench believed that the original judgment did not take into account the serious criminal circumstances involved in Xu Shaodong's case, and did not consider Mr. Pan and Mr. Lin's prior records in the verdict, imposing only light sentences of 3 and 4 months respectively, which was indeed too lenient. Accordingly, the original judgment was revoked, and today morning, Mr. Pan was resentenced to 5 months imprisonment and Mr. Lin to 6 months imprisonment, both convertible to a fine. The entire case can still be appealed.

The case began when Xu Shaodong, the head of Sanlian Group, entrusted a human smuggling syndicate to arrange his escape to avoid imprisonment. Members of the syndicate first commissioned Mr. Pan and Mr. Lin, for a fee of NT$5,000, to purchase boat tickets from Budai, Chiayi, to Magong, Penghu, allowing Xu Shaodong and others to successfully impersonate others and take the boat to Penghu on May 9, 2025.

Upon arriving in Penghu, Xu Shaodong and others were arranged to hide in a guesthouse by local accomplices. Subsequently, they hired a captain surnamed Li at a high cost to drive a yacht, transporting Xu Shaodong and other illegal passengers to the waters off Qingluo Sandbank, where they transferred to a white speedboat to flee the country. Other principal suspects of the human smuggling syndicate and their local accomplices involved in the case have already been sentenced in the first trial by the Penghu District Court.
