(Reporter Hung Hsueh-kuang, Kaohsiung 30th) A Kaohsiung police officer surnamed Tu was indicted for illegally photographing the private body parts of six female complainants and synthesizing nude photos using AI, under the guise of performing official duties and inspecting injuries. The Kaohsiung District Prosecutors Office indicted him for violating the Personal Data Protection Act, among other charges. The city police department stated that he was originally given one major demerit and transferred, but after the indictment, the disciplinary action was changed to two major demerits and dismissal.

The Kaohsiung City Police Department explained this morning that during the investigation period, before the Kaohsiung District Prosecutors Office concluded its investigation, Officer Tu had already been given one major demerit and transferred to another unit, with enhanced supervision. After the prosecutor's investigation concluded and he was indicted, he was immediately given two major demerits and dismissed, unequivocally eliminated.

The Kaohsiung District Prosecutors Office indictment states that Tu, formerly a police officer at a police station in the Sanmin First Precinct of the Kaohsiung City Police Department, took advantage of his official position to prey on six female complainants between July 2023 (ROC year 112) and March 2024 (ROC year 113). This included handling non-road traffic accidents, computer misuse cases, and lost phone cases, during which he pretended to be performing official duties and inspecting injuries, requesting the victims to raise their hands and photograph their chests and armpits.

Tu also went to the victims' residences under false pretenses, asking them to remove their tops and wear only sports bras, or falsely claiming that "suspects might hide items in the soles of their feet," requesting victims to sit on beds and photograph their private parts. Additionally, Tu secretly recorded photos of female complainants' buttocks and legs while they were using the restroom at the police station.

After illegally collecting images of six women, on September 16, 2024 (ROC year 113), Tu used his mobile phone to open an AI program, synthesizing these six women's photos with virtual nude images for his personal viewing. The case was investigated under the direction of the Kaohsiung District Prosecutors Office, and Tu's mobile phone and electronic devices were searched and seized twice.

The prosecutor determined that Tu's actions violated the Personal Data Protection Act, the crime of public officials illegally collecting and using personal data by abusing their official authority, and the crime of secretly recording sexual images of others without consent. Considering the grave nature of his crimes, the Kaohsiung District Court was recommended to increase his sentence according to the Personal Data Protection Act, sentencing him to 3 years and 6 months in prison and a fine of NT$300,000.
