Kaohsiung Prosecutors Office has indicted him for violating personal data protection laws and other offenses, recommending a heavy sentence of 3 years and 6 months imprisonment.
The Kaohsiung District Prosecutors Office indictment states that Tu, originally a police officer at a police station in Sanmin First Precinct, Kaohsiung City Police Department, took advantage of his position between July 2023 and March 2024 to prey on 6 female complainants. This included handling non-traffic accidents, computer misuse, and lost phone cases, where he used the pretext of performing duties and checking injuries to ask victims to raise their hands and take photos of their chests and armpits.
Tu also once fabricated an excuse to visit a victim's residence, demanding that she take off her top, only wearing a sports bra, or falsely claiming that "the suspect would hide items on the soles of their feet" to ask the victim to sit on the bed and take private photos. In addition, Tu secretly recorded the buttocks and leg privacy photos of female complainants using the toilet at the police station.
After illegally collecting images of 6 women, on September 16, 2024, Tu used a mobile phone AI program to synthesize these 6 women's photos with virtual nude images, creating nude photos for his personal viewing. The case was investigated under the direction of Kaohsiung District Prosecutors Office prosecutors, and Tu's mobile phone and electronic equipment were seized in two separate searches. Afterwards, the police gave him one major demerit and transferred him to a different service area, severely pursuing accountability for inadequate personnel supervision.
Prosecutors considered that Tu, as a police officer, should have strictly adhered to his duties, but instead, merely to satisfy his illegal personal desires, repeatedly abused his authority when receiving reports, illegally filming women's bodies, causing indelible privacy harm. His actions have severely damaged the integrity and image of the police force, causing serious erosion of public trust in public power.
The prosecution determined that Tu's actions constituted violations of the Personal Data Protection Act, the crime of illegally collecting and using personal data by a public official abusing power in the course of their duties, and the crime of secretly recording others' sexual images without consent. Considering the egregious nature of his criminal acts, the Kaohsiung District Court is recommended to impose an aggravated sentence under the Personal Data Protection Act, a heavy sentence of 3 years and 6 months imprisonment, and a concurrent fine of NT$300,000.
