The Taoyuan District Prosecutors Office today indicted the company in Taiwan, Mr. Gong, and business manager Cai on suspicion of violating the Act Governing Relations between the People of the Taiwan Area and the Mainland Area.

The Taoyuan District Prosecutors Office indictment states that 58-year-old Mr. Gong previously served as the general manager of Huizhou Daya Bay Sanmeida Optical Technology Co., Ltd. and concurrently as the head of R&D, while 45-year-old Mr. Cai served as the assistant manager of the sales department of the company and is currently the business manager of Taiwan Jingmeiida Company Optical Technology Co., Ltd.; the responsible person of Huizhou Sanmeida Company is a Chinese national surnamed Li.

The indictment states that Mr. Gong and Mr. Cai, knowing that enterprises in the mainland area are not allowed to engage in business activities in Taiwan without permission from the competent authority, established Taiwan Jingmeiida Company in 2017 with funding from Mr. Li as an operating base to meet the technical research and development needs of Huizhou Sanmeida Company and to serve Taiwanese customers.

The indictment states that Taiwan Jingmeiida Company's registered representatives were Mr. Gong and Mr. Li's son. Mr. Cai was responsible for renting a location in Taoyuan City as an office, with Mr. Gong serving as general manager and Mr. Cai as business manager.

The indictment states that Mr. Gong and Mr. Cai, in 2017, recruited talent in Taiwan for Huizhou Sanmeida Company under the instruction of the chairman of Guangdong Yongchang Group, Mr. Li. They successively hired more than 10 R&D engineers under the name of Taiwan Jingmeiida Company to form an R&D team, engaged in research and development, design, testing, and customer development of voice coil motors for mobile phone camera lenses.

The indictment states that Taiwan Jingmeiida Company is affiliated with the R&D department of Huizhou Sanmeida Company. Its main business is to respond to customer product needs conveyed by Huizhou Sanmeida Company's sales personnel. Related progress reports and discussions were made with Huizhou Sanmeida Company, and salaries and finances were funded to Taiwan Jingmeiida Company through triangular trade commission income.

The indictment states that from July 2017 to May 2025, Taiwan Jingmeiida Company's total foreign exchange income was approximately NT$858.04 million, and foreign exchange expenditure was approximately NT$751.48 million, with the difference serving as Taiwan Jingmeiida Company's operating capital in Taiwan.

Taoyuan Prosecutors Office believes that Mr. Gong and Mr. Cai are suspected of violating Article 40-1, Paragraph 1 of the Act Governing Relations between the People of the Taiwan Area and the Mainland Area, and according to Article 93-2 of the same act, they were indicted today after investigation, with a maximum sentence of three years in prison; the corporate defendant Taiwan Jingmeiida Company will also face fines under the same act.
