The Supreme Court yesterday rejected the appeals, making the judgments final, and prosecutors have been notified to initiate escape prevention mechanisms.

In addition, the Supreme Court also overturned the second instance judgments of the Taiwan High Court regarding the forfeiture concerning Xu Zhenlun, as well as the sentences of 2 years for Xu's secretary Shen Man-chun, 3 years for former detective squad leader Cai Chong-wen of the Songshan Precinct Investigation Team of Taipei City Police Department, and 2 years and 6 months for Xu's assistant Li Wei-ci, remanding these parts to the High Court for retrial.

The second instance judgment pointed out that Xu Zhenlun served as the actual head of Changzheng Capital Company (originally named Yinhe Hongli Company), and Zhong Long-ying (under investigation by prosecutors) was a casino gambling intermediary operating the Hongli VIP Club within the Macau Taipa Galaxy Entertainment Group. Xu Zhenlun was an intermediary under Zhong Long-ying.

The judgment indicated that starting from around 2012, Xu Zhenlun successively recruited victims to invest in the Hongli VIP Club, claiming that due to the club's high profitability, investors could be guaranteed high monthly dividends and principal repayment upon investment maturity, offering high-reward preferential conditions. The total scale of fundraising reached over NT$3 billion.

According to the judgment, Cai Chong-wen was accused of lending money to Xu Zhenlun to gain exorbitant profits and also recruited subordinates, including detective officers Pan Sheng-da and Huang Hui-ting, and squad leaders Wu Chong-xiong and Li Rui-zhen (a couple), to lend money to Xu. Pan Sheng-da thus absorbed funds totaling NT$27,541,700, Wu Chong-xiong and Li Rui-zhen absorbed funds totaling NT$15,103,500, and Huang Hui-ting absorbed funds totaling NT$28,591,200.

The collegial panel pointed out that Xu Zhenlun was previously sentenced to 5 years in prison for violating the Banking Act, yet he illegally raised funds again during the trial, showing no remorse. Furthermore, Xu played a core role as the main person responsible for the offenses in this case, with total funds raised amounting to NT$3 billion, involving numerous victims. After the offenses, he did not reach a settlement with the victims or compensate for losses. Therefore, he was sentenced to 20 years in prison for two counts of illegal banking operations under the Banking Act (recidivism).

According to the judgment, Xu Zhenlun's unseized criminal proceeds still amounted to over NT$1,041,940,000, which, in addition to being returned to victims or those entitled to claim damages, shall be confiscated. If all or part of it cannot be confiscated or is unsuitable for execution, its equivalent value shall be recovered.

As for Pan Sheng-da, Huang Hui-ting, Wu Chong-xiong, and Li Rui-zhen, the second instance sentenced them for illegal banking operations to 2 years and 2 months, 2 years and 2 months, 2 years, and 1 year and 10 months, respectively. Among them, the three police officers had already been definitively dismissed from their posts by a judgment of the Disciplinary Court in 2023.
