(CNA Reporter Liu Shih-yi, Taipei, 23rd) Entertainer NONO (Chen Hsuan-yu) was involved in a case of sexual assault and obscenity against 6 people. He was sentenced to 2 years and 6 months in the first instance. After an appeal, the second instance at the Taiwan High Court rejected the appeal today, maintaining the sentence of 2 years and 6 months. It can be appealed.

In response, the Taiwan High Prosecutors Office stated that it will study whether to file an appeal after receiving the judgment.

The presiding judge of the Taiwan High Court's second instance stated today that regarding the part where Chen Hsuan-yu was found guilty, the original trial's findings were not flawed and the evidence was sufficient; as for the not guilty part, the evidence was insufficient and still needs reinforcement. If the prosecution appeals, it will be limited by the provisions of the Speedy Trial Act.

The whole case originated from the Taiwan "MeToo movement" in 2023. A woman accused NONO (Chen Hsuan-yu) of extending his "wolf claws" through Facebook. Subsequently, multiple people filed lawsuits. The incidents mostly occurred more than 10 years ago, and victims alleged that NONO used his physical advantage to commit assaults. NONO stated via Facebook at the time that he would immediately suspend his entertainment work and sincerely reflect.

The Shilin District Prosecutors Office concluded the investigation and indictment, pointing out that NONO used his fame as an entertainer and work opportunities to meet multiple victims. Successively in 2008, 2010, 2011, and 2013, at locations such as his residence, hotels, and in his car, he used excuses like meeting for work invitations, giving a ride after recording, or sharing a midnight snack to be alone with the victims, subsequently committing offenses against sexual autonomy.

The prosecution determined that NONO committed crimes against 6 women, involving 3 counts of forcible sexual intercourse, 2 counts of attempted forcible sexual intercourse, and 2 counts of forcible obscenity, and thus filed a public prosecution. The first instance Shilin District Court found that when participating in a TV program recording in 2011, NONO asked for the victim's contact information. After the recording ended that night, he continuously contacted the victim, saying he could drive her home. The victim originally declined, but NONO kept inviting her, and the victim, trusting NONO as a well-known senior in the entertainment circle, agreed.

NONO finally drove the car to the Dadaocheng riverbank parking lot, intending to force sexual intercourse with the victim. Because the victim struggled continuously, begged for mercy, and fell to the floorboard of the right rear seat, NONO gave up and did not succeed. NONO's commission of attempted forcible sexual intercourse was supported by clear evidence, resulting in a sentence of 2 years and 6 months. He was found not guilty of the other 6 accused charges due to insufficient evidence from the prosecutor. The prosecution appealed the not guilty parts; NONO appealed the guilty part, and the case was heard by the Taiwan High Court in the second instance.

In addition, the Shilin District Prosecutors Office's subsequent investigation determined that NONO, using his height and physical advantage, also assaulted a female employee of a massage parlor and a female netizen. He was indicted in August last year on two charges of forcible sexual intercourse and forcible obscenity, and the court was recommended to impose a heavy sentence. The case is currently being heard by the Shilin District Court. (Editor: Huang Ming-hsi) 1150423
