(Central News Agency reporter Kuan Jui-ping, Miaoli County, 22nd) Executives from the Chang Chun Petrochemical Miaoli Plant are suspected of leaking trade secrets such as copper foil technology to China's Guangdong Yinghua Electronic Technology Co., Ltd., and were subsequently poached by the company. The Miaoli District Prosecutors Office concluded its investigation today and indicted the two individuals on charges of violating the Trade Secrets Act.

Two men, surnamed Cho and Liu, were originally employed at the Chang Chun Petrochemical Miaoli Plant and had been dispatched to China as mid-to-high-level executives since 2022 and 2018, respectively.

The indictment pointed out that prior to their resignation at the end of 2024, Cho and Liu allegedly sent trade secrets they knew regarding Chang Chun Petrochemical's copper foil manufacturing technology and lithium battery production—such as production methods, technology, manufacturing processes, formulas, and other information applicable for production, sales, or operations—from the company's public email accounts to their private email accounts and stored them on their mobile phones. They then leaked the information to Guangdong Yinghua Electronic Technology Co., Ltd. via the Chinese communication software WeChat.

The indictment mentioned that after resigning, Cho jumped ship to work for Yinghua. Even though he clearly knew that Yinghua Electronic is a profit-seeking enterprise in the mainland area and must obtain permission from the competent authority, the Investment Commission of the Ministry of Economic Affairs (now restructured as the Department of Investment Review, MOEA), and establish a branch or office in Taiwan before engaging in business activities such as investment promotion, member recruitment, sales, and human resources recruitment in Taiwan, he privately acted under Yinghua's instructions to recruit and interview Liu, inviting him to work for Yinghua.

Chang Chun Petrochemical internally noticed anomalies and reported to the police for investigation. The case was directed by Prosecutor Wu Chia-wei of the Miaoli District Prosecutors Office and investigated by the Miaoli County Investigation Station of the Investigation Bureau, Ministry of Justice. The investigation concluded today, indicting Cho and Liu on charges including intending to use trade secrets in the mainland area to infringe upon trade secrets under the Trade Secrets Act, unauthorized reproduction and leaking of trade secrets, and violations of the Copyright Act. Cho was additionally prosecuted by the prosecutors for allegedly engaging in illegal business activities under the Act Governing Relations between the People of the Taiwan Area and the Mainland Area.
