(CNA Reporter Hung Hsueh-kuang, Kaohsiung, 22nd) Kaohsiung brothers surnamed Chen have long been at odds due to disputes over company operating interests and family property, leading to a physical fight with wooden sticks in their office. The Kaohsiung District Court sentenced both brothers to 8 months in prison for assault; additionally, the younger brother was sentenced to 10 months in prison and 80 days of detention for a portion commutable to a fine.

According to the Kaohsiung District Court's judgment, the Chen brothers served as the nominal person in charge and the general manager of a certain technology co., ltd., respectively. In January 2022, the younger brother took without authorization and embezzled valuable PCTFE rods from the company; later, dissatisfied with his brother's accusation of helping a company run by relatives steal clients, he sent threatening messages directly.

The conflict escalated into physical violence in 2024. Initially, the younger brother caused bruising on the older brother's forearm, and later, both struck each other on the head with wooden sticks, resulting in injuries for both. After the incident, the younger brother's wife, upset by her husband's injuries, joined him in going to the sister-in-law's residence to smash a motorcycle and destroy an intercom and potted plants to vent her anger.

After the Kaohsiung District Prosecutors Office concluded its investigation, it originally indicted the brothers for attempted murder. However, during the trial, the judge of the Kaohsiung District Court reasoned that although both used sticks to attack the other's head, each only struck once, and the injuries did not reach a life-threatening or severe level; moreover, they had a fierce verbal argument before the physical conflict, classifying it as an emotional loss of control and venting behavior. It was hard to establish a direct intent to kill, leading to the modification of the indictment charge to assault.

The judge considered that the brothers did not try to resolve their differences rationally but resorted to violence, and failed to reach a settlement after the incident. The older brother was sentenced to 8 months in prison for assault. The younger brother committed five crimes including occupational embezzlement, threats endangering safety, assault, and destruction of property. He was sentenced to 8 months for the non-commutable portion; and 10 months in prison and 80 days of detention for the commutable portion. The younger brother's wife was sentenced to 45 days of detention for joint destruction of property, which is commutable to a fine. The case can be appealed. (Editor: Huang Ming-hsi) 1150422
