The Kinmen District Prosecutors Office announced today that Mr. Yang was indicted for theft and is facing a sentence of 1 year and 6 months imprisonment.

According to a press release issued by the Kinmen District Prosecutors Office, prosecutors received a police report that illegal sand and gravel mining was discovered on August 29, 2025, at the 'Loluo Port North Wharf Embankment Reclamation Project' contracted by the Kinmen County Port Authority. Prosecutors directed a special investigation team, including police and coast guard personnel, to handle the case.

Prosecutors stated that with the cooperation of the Kinmen County Government, relevant units jointly inspected the site, filtered surveillance footage, and successively summoned multiple witnesses. It was found that Mr. Yang, due to insufficient sand sources and failure to meet the contract's scheduled design elevation, was unable to process inspection and valuation for payment.

Prosecutors added that Mr. Yang did not apply for a permit to extract earth and stone from the competent authority. He dispatched excavators to state-owned land managed by the Kinmen County Government in Xintou Section, Jinhu Township, to excavate and stockpile sea sand. He then dispatched several sand and gravel trucks to transport the sea sand to the Loluo Port North Wharf Embankment area for backfill.

Prosecutors stated that during this period, a total of 791 trips were made, stealing approximately 11,074 cubic meters of sea sand in total. This severely damaged valuable national sea sand resources and an attempt was made to obtain a project fee of NT$3,432,940 from the Port Authority for the embankment backfill.

Prosecutors said that the investigation recently concluded, and Mr. Yang was officially prosecuted for theft under the Criminal Code of the Republic of China. Considering the significant adverse impact on national land resources and the coastal environment, and the non-trivial infringement of legal rights, a specific sentence of 1 year and 6 months imprisonment was sought.
