Control Yuan members Ye Dahua and Wang Meiyu stated today through a press release that a serious child abuse case occurred in Zhubei City, Hsinchu County, in 113 (2024). The Hsinchu District Prosecutors Office indicted Ye Zhan-hao and two other defendants in February 114 (2025). Ye Zhan-hao was transferred to the Hsinchu District Court, where the presiding judge granted him bail on the spot. However, Ye Zhan-hao subsequently absconded, fleeing the country to Cambodia by plane and has not yet appeared in court.

The Control Yuan investigation found that the Hsinchu District Court did not notify the prosecutor's office to appear in court during the transfer proceedings, nor did it serve the bail decision to the prosecutor, preventing the prosecutor from filing a timely appeal against the decision. However, the Code of Criminal Procedure does not explicitly require prosecutors to be notified of transfer proceedings, and in practice, most courts do not serve rulings or decisions to prosecutors, reflecting systemic loopholes in the transfer procedure.

The Control Yuan stated that although the Judicial Yuan has sent letters to various courts and the Ministry of Justice in 114 (2025) with "Examples of Court Rulings Notification Letters (Drafts)" for reference, these have no binding effect on judges. It recommends that the Judicial Yuan revise the transfer system of the Code of Criminal Procedure by referring to foreign legislative examples, amending the law to grant prosecutors reasonable rights to know and participate in transfer proceedings.

The Control Yuan's investigation also revealed that regarding the decision by the assigned judge to grant Ye Zhan-hao bail, the judge stated that considering the victim had been placed in care and the defendant admitted to the objective facts of the crime, the risk of re-offending was low. Furthermore, the prosecutor did not present evidence of "risk of flight," thus the preventive measures could not be implemented.

The Control Yuan stated that it respects the court's decision on detention and alternative measures. However, given Ye Zhan-hao's long-term abuse of children, if technological monitoring is not implemented after bail, there is a risk of "repeated commission of the same crime," seriously threatening the personal safety and testimony of the abused children. The presiding judge did not consider the child's best interests and fundamental human rights as stipulated by the Convention on the Rights of the Child, which requires review and improvement.

The Control Yuan's investigation also found that the current operation of technology monitoring faces issues such as the need for hardware and software system upgrades and acquisitions, unfriendly design, staff shortages, difficulty for domestic violence or abuse victims to promptly track perpetrators' locations, and the need for collaborative efforts with police agencies in practical implementation.

The investigation report points out that current technology monitoring notification targets do not include victims, making it difficult for victims to obtain timely information on perpetrators' locations and live in constant fear. Therefore, the Judicial Yuan and the Ministry of Justice should refer to foreign legal systems to add mechanisms for tracking the whereabouts and activities of monitored individuals through technology during the monitoring period, and establish a two-way notification system to assist victims in promptly tracking perpetrators' locations and movements, thereby protecting victims' personal safety and freeing them from the fear of domestic violence and abuse.
