(CNA Reporters Hsieh Chun-lin, Liu Shih-yi, Taipei, 15th) The Intellectual Property and Commercial Court ruled today that BES Engineering Corporation (BES) must include the director and independent director candidates proposed by shareholders such as Bao Xin and Dahua Construction into the election list for the regular shareholders' meeting. Shareholder-appointed lawyer Lin Cheng-chiang went to the Taipei District Court in the afternoon to submit a NT$3.3 million guarantee deposit and applied for compulsory execution.

BES Engineering Corporation will hold a shareholders' meeting on May 21 to re-elect 4 directors and 3 independent directors. Bao Xin Investment, Dahua Construction, and Jia Jun Investment each submitted a list of candidates according to relevant regulations of the Company Act; the BES board of directors deleted the shareholders' nominations on the 10th on the grounds of combined calculation and over-nomination; shareholders such as Bao Xin then applied to the Intellectual Property and Commercial Court for an "injunction maintaining the temporary status quo".

The Intellectual Property and Commercial Court approved the applications of Bao Xin, Dahua, and Jia Jun today. Bao Xin and Dahua's appointed lawyer Lin Cheng-chiang went to the Taipei District Court in the afternoon to pay the guarantee deposit of NT$3.3 million and applied for compulsory execution.

Lin Cheng-chiang stated that because the Intellectual Property and Commercial Court's ruling must be compulsorily executed by the Taipei District Court, the guarantee deposit for each group of candidates is NT$1.65 million, totaling NT$3.3 million for the two groups. He hoped the Taipei District Court would swiftly execute the Intellectual Property and Commercial Court's ruling.

BES Engineering Corporation responded that it respects the Intellectual Property and Commercial Court's ruling. (Editor: Lung Po-an) 1150415
