(CNA, Reporter Chen Chun-hua, Taipei, July 3) The Legislative Yuan held a roll-call vote today on the confirmation of nominees for the Central Election Commission (CEC). Both the Kuomintang (KMT) and the Taiwan People's Party (TPP) cast dissenting votes against all three nominees. Legislative Yuan Speaker Han Kuo-yu announced that as a result of the vote, Shen Shu-fei, Tsai Wei-che, and Huang Mou-hsin did not receive more than 1/2 of the total votes from all legislators, and therefore cannot be confirmed as CEC members according to law.
On April 21, the Executive Yuan submitted the nominations of former Executive Yuan Counselor Shen Shu-fei, lawyer Tsai Wei-che, and Deputy Minister of Justice Huang Mou-hsin as CEC members to the Legislative Yuan for review. The Legislative Yuan convened this afternoon at 1 p.m. for a roll-call vote and began counting the ballots at 2 p.m.
Legislative Yuan Vice Speaker Chiang Chi-chen stated that the report on the vote for the confirmation of CEC personnel indicated that 111 legislators collected ballots, while 2 did not. It is understood that the two legislators who did not collect ballots were Speaker Han Kuo-yu and Democratic Progressive Party (DPP) legislator Lin Yi-chin.
According to Article 29 of the "Act Governing the Exercise of Powers by the Legislative Yuan," when the Legislative Yuan exercises its power of consent for personnel appointments as stipulated by law, it shall, without debate, be referred to the relevant committee for review. After review, the committee shall submit its report to the Yuan for a roll-call vote. A motion is passed if it receives the consent of more than 1/2 of all legislators; that is, nominees must receive at least 57 affirmative votes to be confirmed.
Finally, Speaker Han Kuo-yu announced at the plenary session that the voting results were as follows: Shen Shu-fei received 50 affirmative votes, 60 dissenting votes, and 1 invalid vote. Tsai Wei-che received 50 affirmative votes and 61 dissenting votes. Huang Mou-hsin received 50 affirmative votes and 61 dissenting votes. Shen Shu-fei did not receive more than 1/2 of the total votes from all legislators and therefore cannot be confirmed as a CEC member and vice chairperson according to law. Tsai Wei-che and Huang Mou-hsin did not receive more than 1/2 of the total votes from all legislators and therefore cannot be confirmed as CEC members according to law.
According to the vote count, DPP legislators cast affirmative votes for all three nominees, while KMT and TPP legislators cast dissenting votes. Shen Shu-fei received one invalid vote, cast by KMT legislator Lu Hsien-yi. (Editor: Lin Hsing-meng) 1150703
