The Taiwan High Court has ruled in favor of professional basketball player Gursimran Singh Bhullar in his lawsuit against TSG Sports Marketing. The club had terminated Bhullar's contract citing his 15-week injury recovery period and failure to provide evidence of fitness. The court found the termination invalid, ordering the club to pay approximately 10.38 million TWD in outstanding salary and housing allowances.
Bhullar alleged that he sustained a ligament tear in his right big toe during a game on January 6, 2024. Despite receiving medical treatment, he claimed the coaching staff pressured him to play. Following the injury, Bhullar stated he followed the team's recovery protocols. However, the club unilaterally terminated his contract on April 17, 2024, claiming he failed to prove his physical fitness.
In its ruling, the High Court noted that the club failed to specify what documentation was required to prove fitness or provide a reasonable timeline for such proof. Furthermore, since the club monitored Bhullar's rehabilitation and adjusted his training accordingly, they were fully aware of his recovery progress. Consequently, the court deemed the termination unreasonable. The case remains subject to further appeal.
