[Key Lecture Content]
In Japan, the draft of the AI Principle Code (tentative name) presents a core framework aimed at generative AI developers and providers, which includes the disclosure of overviews, responding to disclosure requests from right holders, and responding to disclosure requests from users. On the other hand, in the EU, the transparency obligations of the AI Act will apply from August 2, 2026, requiring notifications when interacting with AI, machine-readable labeling of AI-generated content, notifications regarding emotion recognition and biometric categorization, and labeling of AI-generated text regarding deepfakes and matters of public interest. Furthermore, in the EU, obligations for GPAI model providers will apply from August 2, 2025, and the GPAI Code of Practice and training content summary templates are being prepared.

In the US, rather than a unified federal law, transparency regulations are being formed state by state. For example, in Colorado, starting June 30, 2026, developers and deployers of high-risk AI will be required to provide public statements, impact assessments, and consumer notices. Conversely, the obligation to disclose that an AI is indeed an AI for general conversational AI is not a central obligation of the current Colorado AI Act, but is slated to be addressed in a separate conversational AI bill currently under deliberation. In Utah, disclosure obligations and safe harbors have been established for AI interactions in consumer transactions and regulated professions in certain cases. In California, a system has been introduced requiring generative AI developers to document on their websites the sources of training data, types of data, volume ranges, presence of purchases/licenses, and presence of personal information.

This seminar will not merely introduce these systems but will interpret them through practical issues: what Japanese companies should disclose, the extent of their accountability, and how they should confront the issues of training data and copyright. As peripheral topics, we will also cover the basics of AI training and copyright including Article 30-4 of Japan's Copyright Act, practical responses to right holders in Japan, copyright policy and training content summary in the EU, and the impact of litigation and state law trends in the US.
